ADOPTED RESOLUTION REGARDING DELEGATION OF AUTHORITY TO THE STATE SUPERINTENDENT TO REVIEW AND APPROVE TEXTBOOKS FOR THE USE BY LOCAL BOARDS OF EDUCATION

WHEREAS, numerous local Legislative Acts authorize local boards of education to vote upon and approve textbooks for use in that local system which may not be on the approved state textbook list; and,
 
WHEREAS, local boards of education submit locally approved lists to the State Board of Education for approval of textbooks for use in that local system; and
 
WHEREAS, these locally approved textbook lists contain books which may or may not have been reviewed by the State Textbook Committee and the State Board of Education is requested to approve books in this manner; and,
 
WHEREAS, the members of the State Board of Education believe it would be more prudent and efficient for the state approval process regarding the locally approved textbook lists be delegated to the State Superintendent of Education.
 
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Ala. Constitutional Amendment 284 and Ala. Code §16-3-11 (1975), the State Board of Education delegates the authority to approve textbooks submitted by local boards of education for use in that system to the State Superintendent of Education; and
 
BE IT FURTHER RESOLVED, the State Superintendent of Education shall have the authority to approve textbooks which (1) have been reviewed and approved by a local board of education, (2) appear on a list submitted by a local Board of Education which has been granted authority to prepare a local list of approved textbooks by an Act of the Alabama Legislature.
 
BE IT FURTHER RESOLVED, that this delegation of authority would be limited to systems with a specific Act from the Legislature. In the event the State Superintendent of Education should have reservation concerning any book on a local list, then the State Superintendent may bring that local textbook to the State Board of Education for discussion and vote.
